Terms and Conditions

1. Introduction

   These Terms and Conditions (the "Terms") govern your use of the Bonappo app (the "App") and any services provided by Bonappo (the "Services"). By using the App or Services, you agree to be bound by these Terms.

2. Eligibility

   The App and Services are only available to users who are 18 years of age or older. If you are under the age of 18, you may only use the App or Services with the consent of your parent or guardian.

3. Account Creation

   In order to use the App or Services, you must create an account. When you create an account, you will be asked to provide certain information, such as your name, email address, and password. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

4. Use of the App and Services

   You may only use the App and Services for lawful purposes. You may not use the App or Services to:

   • Transmit or post any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable;
   • Harm minors;
   • Impersonate any person or entity;
   • Violate the privacy of any person or entity;
   • Upload or transmit any viruses or other harmful code; or
   • Interfere with the App or Services in any way.

5. Termination

   Bonappo may terminate your account at any time for any reason, including if you violate these Terms.

6. Modifications to the Terms

   Bonappo may modify these Terms at any time. Any modifications will be effective immediately upon posting to the App or Services. You are responsible for reviewing the Terms periodically to ensure that you are aware of any modifications.

7. Governing Law

   These Terms will be governed by and construed in accordance with the laws of the Spanish government and European Union regulations, without regard to its conflict of laws provisions.

8. Entire Agreement

   These Terms constitute the entire agreement between you and Bonappo regarding the App and Services. These Terms supersede any prior or contemporaneous communications, representations, or agreements, whether oral or written.

9. Severability

   If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck from these Terms and the remaining provisions will remain in full force and effect.

10. Waiver

    No waiver of any provision of these Terms will be effective unless in writing and signed by both parties.

Disclaimer of Warranties: Bonappo makes no representations or warranties about the App or Services, including but not limited to the accuracy, completeness, or timeliness of the content, or the reliability of the App or Services. Bonappo is not responsible for any damages that you may suffer as a result of using the App or Services.

1. Limitation of Liability: Bonappo's liability to you for any damages arising out of or related to your use of the App or Services is limited to the amount you have paid for the App or Services. Bonappo is not liable for any consequential, incidental, or special damages, including but not limited to lost profits, lost data, or damage to your computer system.
2. Indemnification: You agree to indemnify and hold Bonappo harmless from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or Services.
3. Dispute Resolution: Any disputes arising out of or related to these Terms will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be held in Barcelona, Spain, and the decision of the arbitrator will be final and binding.
